What are the National Employment Standards and why do they matter?

The National Employment Standards (NES) are the 12 minimum employment entitlements set out in the Fair Work Act 2009 that apply to all national system employees. They include maximum weekly hours, leave entitlements, flexible working arrangements, parental leave, notice of termination, redundancy pay, and, since 1 January 2024, superannuation contributions. Employers cannot contract out of the NES. Any term in an employment contract or enterprise agreement that provides a lesser entitlement has no effect. Note that in Western Australia, sole traders and most partnerships sit in the WA state system, where most of the NES do not apply. LevelUp works across both systems.
